1. Scope and provider

These general terms and conditions apply to all contracts for yoga classes that you conclude with me via the website vanessa-yoga.com. For dates that we arrange by email following a request, they apply if I refer to them in my proposed date.

The provider is:

Vanessa Winkler
Herthastraße 36
80639 München
Phone: +49 157 88345304
Email: hello@vanessa-yoga.com

On the payment page, on your bank statement and in the header of the invoice, my display name “Vanessa Yoga” appears.

Please send questions and complaints to this email address; I usually reply within 1–2 working days.

2. Services

I offer group yoga classes and one-to-one classes, each either in person or online via Google Meet. The date, duration, location, type of class and price are shown in the booking calendar on the website. Online classes take place exclusively live at the booked date and time; there are no recordings.

Yoga is not a substitute for medical or therapeutic treatment.

3. Booking and conclusion of the contract

  1. You select a date in the calendar, enter your name and your email address and are redirected to the payment page of my payment service provider Stripe. The dates in the calendar do not yet constitute a binding offer.
  2. Before you submit, the payment page shows you the class, date, time, location and total price once more, including any discount. You accept these terms and conditions by ticking the box. By clicking “Pay” – or, with Apple Pay or Google Pay, by authorising the payment – you make a binding offer to book this class. I accept it as soon as Stripe has successfully completed the payment; the contract is thereby concluded, and you are redirected to a confirmation page. If a voucher code covers the full price, the contract is concluded when you complete the booking on the payment page. If the payment is declined or you cancel the process, no contract is concluded.
  3. You can identify and correct input errors as follows: in the booking window, you see and can change the date, name, email address and telephone number before you click “Continue to payment”. On the payment page, you correct your payment details directly. To change the date, name or email address after that, go back using the arrow at the top left of the payment page or your browser’s back button and start the booking again. Until you click “Pay”, you can cancel at any time by closing the page.
  4. After the booking, my payment service provider Stripe sends you a payment receipt and an invoice by email. They state the class, the date, the location or the link to the online room, the price and the most important conditions of these terms and conditions. On request, I will send you the complete terms and conditions as a PDF.
  5. You can book online no later than 3 hours before a class starts and no more than 8 weeks in advance.
  6. Requests made via the request form (e.g. for a preferred date) are non-binding. I reply by email with a proposed date, the price and a reference to these terms and conditions. The booking only becomes binding once you confirm my proposal.
  7. You can book in German, English, Italian, Spanish or French. The contract is concluded in the language in which you book; the payment page, receipt and invoice appear in that language. I store the contract data (class, date, price, your details) with my payment service provider Stripe; you receive them by email as a payment receipt and invoice. There is no customer account for accessing them later. You can view, print or save these terms and conditions here at any time; I will send you earlier versions on request.

4. Prices and payment

  1. All prices are final prices in euros. As a small business owner under § 19 of the German VAT Act (UStG), I do not charge VAT and do not show it separately.
  2. You pay for the class in advance when you book, via my payment service provider Stripe. You can pay by Visa, Mastercard or American Express credit or debit card and – depending on your device and browser – with Apple Pay or Google Pay. The amount is charged immediately.

5. Discount on the first class and voucher codes

  1. On your first booking you receive a one-time discount of 20 % on the regular price (“trial class”). I determine whether it is your first booking by whether a booking via the website has already been completed under your email address. The discount is deducted automatically on the payment page; there you see the final price before you pay. Otherwise, the same conditions apply to the trial class as to any other class.
  2. The discount applies once per person. If you knowingly book under a different email address although you have already booked with me, you are not entitled to the discount; I may then claim the difference to the regular price.
  3. Voucher codes are valid under the conditions stated when they are issued. Only one discount is possible per booking; a voucher code therefore cannot be combined with the discount on the first class. Voucher codes are not redeemable for cash.

6. Rebooking, substitute, cancellation and no-shows

  1. Up to 24 hours before the start, you can rebook your class free of charge to another available date of the same type (group or one-to-one class). To do so, write to me, most easily by email to hello@vanessa-yoga.com; the time your message is received is decisive. If no available date that suits you can be found within 3 months of the original date, I will refund the price you paid on request.
  2. You can pass your place on to another adult up until the start of the class; your contract with me remains in place. Please tell me their name and email address beforehand. I will then send them the link to these terms and conditions and to the privacy policy and ask them to tell me about any health problems before the class; they take part on these terms. For online classes, you pass the link to the online room on to them.
  3. If you cancel less than 24 hours before the start or do not take part, rebooking is no longer possible and the agreed price remains payable. This also applies if you booked the class less than 24 hours before the start. However, I will deduct any expenses I save as a result and anything I earn by giving your place to someone else. You are entitled to prove to me at any time that this is the case.

7. Cancellation of a class

If a booked class cannot take place – for example because I am ill, due to force majeure, due to a disruption at Google Meet or a technical fault on my side – or if a place has been allocated twice due to a technical error, I will inform you without undue delay by email and, if you have provided a telephone number, also by phone where possible. You can then choose between a replacement date and a full refund of the price paid; I will initiate the refund to your payment method within 14 days. Any further claims, in particular for damages, are governed by section 10.

8. Online classes

  1. Online classes take place via Google Meet. You will find the link to the online room in your invoice; if, exceptionally, it is not included there, I will send it to you by email before the class. Please do not pass it on – except to a substitute under section 6.2.
  2. You need a stable internet connection, a device with a microphone and an up-to-date browser or the Google Meet app. So that I can guide and correct you, please switch on your camera if possible; you can switch it off at any time, though. Open the link shortly before the start and click “Ask to join”; I will then let you in.
  3. I do not record the classes. Please do not record them either, neither video nor audio.
  4. If you are unable to take part due to technical problems on your side, this is treated as a no-show (section 6). In the event of disruptions on my side or at Google Meet, section 7 applies.

9. Times

All times refer to German local time (Europe/Berlin). For online classes, the website, payment page and invoice additionally show your local time; German time is always shown alongside it and is authoritative.

10. Health and liability

  1. Please clarify any health problems, injuries or a pregnancy with your doctor beforehand and let me know before the class so that I can adapt the exercises. Whether and what you tell me is up to you; how I handle such information is set out in section 8 of the privacy policy. Respect your limits during the class and tell me if something does not feel right for you. If you practise online, please make sure you have enough space and a non-slip surface.
  2. I am liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the case of slight negligence, I am liable only for the breach of essential contractual obligations, i.e. those whose fulfilment is what makes the proper performance of the contract possible in the first place and on whose observance you may normally rely, and even then only for the foreseeable damage typical of the contract.
  3. For items and valuables you bring with you, I am liable only in accordance with paragraph 2. For in-person classes, please observe the house rules of the respective studio.

11. No right of withdrawal

There is no right of withdrawal. Under § 312g(2) no. 9 of the German Civil Code (BGB), there is no right of withdrawal for contracts for services in connection with leisure activities if the contract provides for a specific date for their performance. Every yoga class – in person as well as live online – takes place on the booked date, and I keep your place free for it. Online classes take place exclusively live; there are no recordings. Your option to rebook free of charge under section 6 remains unaffected.

12. Data protection

You can find out how I process your data in the privacy policy.

13. Final provisions

  1. The law of the Federal Republic of Germany applies. If you are a consumer with your habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected.
  2. I am neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
  3. Should any provision of these terms and conditions be invalid, the remainder of the contract remains valid.
  4. These terms and conditions are also available in German, Italian, Spanish and French. All versions have the same content. Should they ever differ, the version more favourable to you applies.
